Once I’ve drafted my documents, what do I do?
Once you’ve created your documents, you should get them signed and notarized and, in the case of the Trust, take the steps to fund it with your assets. Don’t worry, Suze provides clear instructions in her online program so you can easily complete all steps.
What is the Difference between a Will and a Trust?
A Will is a legal document that directs who will receive your assets upon your death and allows you to name a guardian for your children. A Living Revocable Trust holds titled property for the benefit of the named beneficiaries and takes effect as soon as you create it. A trust passes outside of probate, saving you time and money. In addition, a Living Revocable Trust makes one able to protect their minor children through the trustee’s handling of their estate. And lastly a LRT has an incapacity clause so you can designate who is to cover for you if you were to become incapacitated. Better you than the government!
Should a Living Revocable Trust (LRT) be the primary beneficiary of my retirement account?
If you are married, your spouse should be the primary beneficiary of your retirement account, not the Living Revocable Trust. If you are single, then the LRT may be the primary beneficiary of your retirement account.
If I have a Living Revocable Trust, do I need a Will?
Yes, you still need a Will if you have a Living Revocable Trust because the Trust only covers assets with a title (home, bank account, retirement account, car, etc.). Wills can cover anything you want to assign to another upon your death. In addition, a Will allows you to name a guardian for your children.
